1. Purpose
These Terms and Conditions of Sale ("Terms") govern the sale of cannabis seeds by Aristode Seed Co. (Tomy Caron, sole proprietorship, SIRET 984 533 034 00018) on aristodeseedco.com. Any order placed on the site constitutes full and unconditional acceptance of these Terms.
2. Products
The seeds offered are sold exclusively for genetic preservation and collection purposes. They are not intended or sold for cannabis cultivation. Aristode Seed Co. offers no guarantee as to germination rate, which depends on factors beyond its control (storage, preservation, and handling conditions after delivery).
3. Minimum age
The sale of our products is strictly reserved for adults (18 years and older). By placing an order, the customer certifies being at least 18 years old.
4. Prices
Prices are shown in euros (€). VAT not applicable, Article 293 B of the French General Tax Code — Aristode Seed Co. operates under the VAT exemption scheme for small businesses (franchise en base de TVA). Aristode Seed Co. reserves the right to change its prices at any time, it being understood that the price shown on the order at the time of validation is the only one applicable to the buyer.
5. Order
The order is final only after confirmation by email from Aristode Seed Co. An order summary is sent to the customer at the email address provided when ordering.
6. Payment
Payment is made exclusively by bank transfer (SEPA). Bank details are provided to the customer after the order is placed. The order is processed and shipped upon receipt of the transfer, within an indicative period of 1 to 2 business days.
7. Delivery
Aristode Seed Co. ships worldwide, except to countries subject to international sanctions or for which shipping is not supported. Shipping costs, calculated based on destination, are shown before the order is validated. Delivery times are indicative and may vary depending on destination and carrier.
8. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods unsealed by the consumer after delivery which cannot be returned for reasons of hygiene or health protection. As our seeds fall under this exception, they cannot be taken back or exchanged once the order has shipped, except in the cases provided for in Article 9 below.
9. Damaged, incorrect, or undelivered items
In the event of a damaged, defective, or non-conforming product, or an order not received, the customer has recourse as described in our Refund and Returns Policy.
10. Liability
The legal status of possession, germination, and cultivation of cannabis varies by country and region. It is solely the buyer's responsibility to verify the applicable legislation in their place of residence before ordering. Aristode Seed Co. cannot be held liable for any use of the products contrary to applicable law.
11. Legal warranties
The products sold benefit from the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) and the legal warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
12. Personal data
The processing of customer personal data is described in our Privacy Policy.
13. Consumer mediation
In accordance with Articles L616-1 and R616-1 of the French Consumer Code, in the event of a dispute not resolved directly with Aristode Seed Co., the customer may use a consumer mediator free of charge. The competent mediator's contact details will be provided upon simple request to aristodeseedco@gmail.com.
14. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing that, French courts shall have sole jurisdiction.
